Terms of Service

These Terms of Service (“Terms”) govern your use of the ELG Tutoring website at elgtutoring.com, our in-person group classes and mock exams, and the ELG Tutoring learning platform (together, the “Services”), operated by Sagar Prashant Badve (ABN 14 436 379 504) trading as “ELG Tutoring” (formerly ASET Expert) (“we”, “us”). By using the Services you agree to these Terms and our Privacy Policy.
1. Accounts and children
You must be at least 18 and the parent or legal guardian of any child you enrol or add. Children access the platform only through your account; you are responsible for your account and for keeping your login confidential, and you consent to our collection and use of your child’s information as described in our Privacy Policy.
2. Group classes and mock exams
Class places are booked by term and confirmed once payment is received. Term fees, early-bird rates and multi-family rates are those published at the time you enrol. Fees secure a place for the term rather than individual sessions: we do not credit or refund missed sessions, though we will make the session materials available. If we cancel a session, we will reschedule it or credit that session’s share of the term fee.
You may withdraw for a full refund at any time before the term starts. Once the term has started, fees are non-refundable except where required by law. We supervise students during scheduled session times only; parents are responsible for drop-off and pick-up. We may ask a parent to withdraw a student whose behaviour prevents us from running the class safely.
Mock exam registrations are for the named student and the sitting booked. Transfers to another sitting are subject to availability and must be requested before the sitting.
3. Platform subscriptions and billing
Platform access is A$30 per student per month, charged at checkout and auto-renewing until cancelled, via Stripe. We may change prices with notice, effective from your next billing period. You may cancel at any time; access continues until the end of the paid period. Except where required by law, payments are non-refundable. Nothing in these Terms limits any consumer guarantee under the Australian Consumer Law that cannot lawfully be excluded.
4. Acceptable use
You may not share your account or class materials outside your immediate family, copy or redistribute our content beyond your own child’s personal study use, attempt to scrape or probe the platform, or upload unlawful or infringing material. We may suspend or terminate accounts and enrolments that breach these Terms.
5. Content and intellectual property
All of our content (questions, passages, mock exams, class materials, explanations, software and branding) is owned by us or our licensors. We grant you a limited, revocable licence to use it for your child’s personal study while enrolled or subscribed. You retain ownership of material your child submits for marking; you grant us a licence to use it to provide the service.
6. Disclaimers and liability
The Services are a study aid provided “as is”, without guaranteeing any exam result, placement or outcome. Except for guarantees that cannot be excluded under the Australian Consumer Law, we exclude all other warranties and are not liable for indirect or consequential loss. Our total liability is limited to the fees you paid us in the 3 months before the claim. You agree to indemnify us against claims arising from your breach of these Terms or misuse of the Services, except to the extent caused by our own negligence or a non-excludable guarantee.
ELG Tutoring is not affiliated with, endorsed by, or approved by ACARA or the Western Australian Department of Education. NAPLAN is a trademark of the Australian Curriculum, Assessment and Reporting Authority. All practice material is original and exam-style; no official test items are reproduced.
Practice and mock exam results are estimates based on our own materials and cohort. They are not official ASET, GATE or NAPLAN scores and cannot predict your child’s official result.
7. Changes, termination and law
We may update these Terms, suspend or discontinue any part of the Services, or terminate accounts and enrolments for breach or non-payment; continued use after an update means you accept the changes. These Terms are governed by the laws of Western Australia, Australia.
